Hi Again, Just would like to thank nhv / bitner / chippy for helping me.
The problem was that I was setting the LAYER STATUS to ON. Thanks to them for pointing out that STATUS ON does not mean Always-On but only Turn-On-If-Asked.. so to always have a LAYER which is shown better put DEFAULT.
