I don't see how any scientific-minded--or minimally intelligent person--can look at the phenomena of identity formation and declare them to be off-limits to scientific observation and analysis because the Bill of Rights and God.
At the same time, it is clear that the so-called human sciences have traditionally been a swamp of lies, deception, error, and sadistic harm-doing that have done untold damage to millions of innocent people. I forget the man's name, but I vividly recall reading an essay by a prominent American pyschoanalyst of the 'fifties and 'sixties who asserted in all seriousness that a trained analyst could always detect a "homosexual" by a peculiar musty odor that all of them gave off. People believed this shite and expected you to have a quiet, rational discussion about it instead of getting all (neurotically) riled up--just as, I seem to recall reading, some Nazis thought the Jews were earning their bad reputation by not sitting down and calmly discussing "the Jewish question." Despite this kind of thing, at the end of the day, I'm for transgender rights not because I think God wants some of his children to be transgender and some gay--and some no doubt both--but because gay and transgender rights are transparently in the best interests of society, bathrooms be damned. The hell with JD Rowling, her fraudulent feminism, and those creepy, creepy novels. When I look at someone like Chelsea Manning, I have no need to apply "science" to my opinion of her activity beyond observing as a fact that she has proved herself an exemplary citizen. That is something anyone can do no matter what their sexual or gender identity, unless other distinct and unrelated character issues are present.
