The Democrats will buzz around, complain and count on the Supreme Court to "do the right thing" as a member of the Paul Wellstone Democratic Club put it to me. (It's possible that they will in this case, but does anybody want to bet the house on it?) The union leadership will be silent out of cowardice and complicity. The geniuses of the sectarian ultra left will be silent because they cannot under any circumstances appear to be supporting the capitalist Democratic Party. Maybe the soft left, like those in Tempest, will write a scholarly article some time about it. Thus, all of them are the same in practice.
WASHINGTON—The Trump administration on Monday asked the Supreme Court to allow federal agencies to implement an executive order that would restrict mail-in ballots and create lists of people deemed eligible to vote ahead of the November midterms. The order, which President Trump issued in March, seeks to insert the executive branch into the supervision of federal elections. Many experts on election law have questioned its legality because the Constitution gives power over elections to states and Congress, not the president. John Sauer asked the high court to lift a lower-court injunction that has blocked the administration from enforcing the order. Sauer urged the justices to intervene now so that federal agencies would have enough time to put the order into effect before the Nov. 3 midterms. Trump has for years denigrated mail voting and sought to sow doubts about U.S. election integrity, including most recently in a prime-time speech <https://www.wsj.com/politics/elections/trump-address-speech-midterm-elections-ce2f117e?mod=article_inline> . In his March 31 executive order <https://www.wsj.com/politics/policy/trump-orders-creation-of-national-eligible-voter-list-d1a088dc?mod=article_inline>, Trump directed the Department of Homeland Security to compile state-by-state lists of citizens who are eligible to vote, and he ordered the U.S. Postal Service not to handle mail ballots from voters who don’t appear on official lists. Democratic officials in 23 states and the District of Columbia sued to challenge the order, arguing that it was unconstitutional, and that its procedures could be abused and disenfranchise many eligible voters. U.S. District Judge Indira Talwani, a Boston-based appointee of former President Barack Obama, blocked the administration from enforcing the order <https://www.wsj.com/us-news/law/judge-blocks-trumps-order-to-create-new-list-of-eligible-voters-4b87aa29?mod=article_inline> in the jurisdictions that sued. The order’s central provisions are “legally void” because they “unconstitutionally violate the separation of powers,” Talwani wrote. On Saturday, a panel of the First U.S. Circuit Court of Appeals denied the administration’s request to set aside Talwani’s injunction. That prompted the administration to file its emergency appeal with the Supreme Court. The appeal didn’t focus on the legality of the executive order. Instead, the administration argued that the states didn’t yet have a legal right to challenge it in court. “The injunction is especially indefensible because the agencies are still deliberating over how (if at all) to implement the order, yet the district court preemptively decided that whatever the agencies may choose to do will necessarily be unlawful,” Sauer wrote. The Democratic states’ response to the administration’s appeal is due next Monday, with a decision from the high court expected soon after. The appeal pulls the justices back into the debate over mail voting.
