case 1: no you do not have to but it would be good to support the cause.

case 2: you distributed the software to company X therefore you conducted a
commercial transaction and must purchase a license.

This is my understanding of how it works after talking with someone from
MySQL.

Should I buy MaxDB license? Should that company who bought my software 
should buy a MaxDB license?
