This is not quite correct. Only versions up to 7.4.03.32 were released under the 
GPL/LGPL.

SAP as the copyright holder can release the software using any licence deemed 
suitable. There is no clause in the GPL that requires the copyright holder to release 
subsequent versions using the GPL as well. Of course, SAP cannot revoke the GPL from 
version 7.4.03.32 and smaller.

If someone else would create a 7.4.03.33, then this release would be bound by the GPL. 
The creator could claim the copyright only for the parts added, so the licence could 
not be changed for anything that is copyrighted by SAP.

There was a transition phase from the first release of MaxDB until March 2004 were 
7.4.03 was still being updated as Open Source. It is now mostly up to MySQL AB to 
decide which versions are released under which licence.
