Because the Finder may not be running. Either quit by an installer or a script 
(weak reason) or when someone uses Path Finder, like I do, and chooses to leave 
the Finder closed (stronger reason).

Ok, so I don't regret the old call if it didn't access the information directly 
either. Still, it seems weird there's no API to get the comment of a file; 
perhaps it's because these are “Spotlight” comments (they used to be plain 
comments prior than 10.4) and so they are “private to spotlight”.
