I'm being asked by HR about playing holiday music at our upcoming staff
holiday breakfast.   Unfortunately, I'm not entirely sure what to tell
them.  The breakfast is being held in a private office space (and not on
museum premises), but I'm not sure where this falls under the public
performance definition.  It's not a large gathering of people (about
30-40 total), but it's not a family/social acquaintances gathering.  Do
you think this would fall under public performance and require an
ASCAP/BMI/SESAC/etc. license, or is it a small, private enough gathering
to be OK?

 

I normally advise the museum to err on the side of caution when it comes
to music licensing, but I would be interested to hear the thoughts of
others out there....
