I would like to follow Perian Sully's email to this group and add my strongest 
encouragement to colleagues not only to consider submitting comments on 
proposed changes to Section 108 but, in fact, to do so.  The deadline is April 
17, so do it tomorrow.

It is critical that the voice of the museum community is heard on Topic 1 to 
include museums with those institutions that are specifically mentioned as 
eligible for the exemptions under section 108 of the US Copyright Act.  Many 
countries recognize museums with archives and libraries in similar exemption 
statutes, and in this country, as activities begin to converge particularly in 
the online environment, it makes little difference if the name over the 
brick-and-mortar door is Museum or Library.  (Maureen Whalen's paper on this 
topic is NOT attached as that is not allowed in this listserv.  If you would

If you have time, please also address two issues raised in Topic 2: adding 
other triggers like "fragile" and "unstable" to those which permit the creation 
of preservation copies; and permitting access services to be delivered 'off 
premises,' exactly what is afforded by current technology and expected by 
curators, scholars and patrons with online access to digital surrogates of our 
museum, archival and library collections.  All the better if you can provide 
specific examples to support the need and the expectation for these changes 
within the mandates for preservation and access we all have by virtue of our 
shared goal to serve the broad public good.

If you have yet more time, read the entire Federal Register notice and comment 
on other changes that may have significant impact for you, given the nature of 
the collections you care for.
