Dear MCN colleagues and IP sig members, If you are a rights and reproductions specialist, you probably read the CAA's "Code of Best Practices in Fair Use" cover-to-cover as soon as it came out (I did). You eagerly downloaded the IMA's wonderful "Rights and Reproductions Handbook" when it was released last summer. So, I am curious to know: 1. How many of us are actually putting fair use doctrine into practice? Did these publications impact your day-to-day operations around rights requests? 2. Does your museum invoke fair use on a regular basis, or does it take a "play-it-safe and clear everything" policy? 3. What types of reproductions do you clear rights for, and which ones not? Catalogues Website - thumbnails (per the AAMD's size guidelines) Website -hi-res Press kits Label illustrations Banners (outdoor, building, street) Paid Advertising Other? 4. Has your fair use ever resulted in financial penalty or lawsuit?
