Illegal to sell, yes. Illegal to Use, probably not.
I use one in a manner that should be protected by "Fair Use". I record
music from my DSS, delete songs I don't like, and defragment the final MD
through a SCMS stripper from Stippler. I am considering writing my "senior
thesis" on the interaction between the codified version of "Fair Use" and
the Digital Millennium Copyright Act.
I may even file a declaratory judgment here in the SD of Indiana as my
writing requirement, which would be great, if I win . . . .
