MP3 is not a format, per se. "MP3" is actually MPEG-1 Layer 3 audio. That
is, it is one of the audio compresion schemes supported by the MPEG-1
standard. And yes, MPEG-1 and MPEG-2 are open standards (MPEG-2 is the
version used in DVD-Video, though DVD-Video uses other, vastly superior
audio storage).
On the other hand, ATRAC is proprietary.
