Apple Requests Nasdaq Hearing After Filing Delay

(RTTNews) - Apple Computer, Inc. (AAPL) said Friday that it would 
request a hearing before the Nasdaq listing qualifications panel 
after the company was informed by Nasdaq staff that it was not in 
compliance with requirements for filing financial reports for the 
third quarter ended July 1.


The Cupertino, California-based maker of iPod music players and 
Macintosh computers said its shares will remain listed on the Nasdaq 
Stock Market, pending a decision by the panel.


Apple said it plans to file its Form 10-Q following the completion of 
the independent investigation into its past stock-option granting 
practices by a special committee of the company's outside directors.


The company also formally notified the Securities and Exchange 
Commission in a filing today that it would delay filing of its third 
quarter 10-Q report.
