This is the only comment I will make on this, and I hope this bickering will
be taken to private channels, and not the main L-list.

For the record, the only messages that are screened out are the obvious
SPAM. If I deem something inappropriate, I will let the sender know WHAT I
find inappropriate, and they usually fix that piece and re-submit, or let me
know why it IS appropriate, and I if I am still unhappy with it, I will then
defer to Gil to make a decision. If I were "censoring" the list, as you put
it, your messages, Mitch, would be screened out. If they had been written
to inspire discussion, they would have been acceptable, but they seem to be
simply trying to stir up something, but since you are a regular list member,
I allowed you the courtesy of expressing your opinions, as I would any
"regular"

As far as Iatric's press release, it is a matter of public knowledge, but I
for one, am so busy, (I DO have a "real" job, too) that I might never have
realized it unless they had posted to the list. I found this just as
appropriate as a vendor hawking excess computer parts for sale. A lot of us
deal with Iatric Systems, and thus have a "need to know". The "other" vendor
has not sent anything to this list, or I would have released it for
everyone.

Thank you for your comments and thoughts. I'm sure others found them, at
least, interesting.

>Mitch,
> I appreciate your comments. Here is my thinking

>1. The L list is for the Meditech user and vendor community. I believe
>the press release was relevant news. Gil did also.

[Mitch Responds: ] He can do what he wants with the L. It is his list. That
doesn't make it ethical.

>2. The information about the litigation is public information according
>to US law and is available in full online

[Mitch Responds: ] True, if you know where to look, or if you have it
foisted upon you during normal online use.

>3. If you were about to purchase a product from a vendor and that
vendor
>was being sued for copyright infringement, isn't that something you'd
>want to know about?

[Mitch Responds: ] I would. But I wouldn't come to the L to find out that
information, it would come up as a normal part of researching a company I
was doing business with.

I could see the press release if the allegations had been proven, but they
have not. At this point that's all it is, allegation. My whole point is that
I believe that the L is the improper place for this information at this
time. And here's why:

We have an imminent bad situation on the horizon, and I am surprised it
hasn't taken place yet. The situation is two vendors using the L as their
personal mudslinging pen. It's only imminent and not actual because the
other vendor seems to be taking the high road and not responding in this
forum, or perhaps Gil/other moderators haven't let the response come through
trying to prevent this from happening, who knows. Right now, the L is one
sided in the favor of the vendor that got their press release through first.

If you guys want to duke it out, fine, do it in the courts, not in the L.

I have absolutely nothing against the product and support you guys give to
the industry. It is top notch.

The press release seemed very one sided, in favor of Iatric Systems, as it
should be, coming from them. It also seemed like the intent was to make sure
the L beware of the other litigant, which is petty in my opinion. This whole
thing is leaving a sour taste in my mouth; I thought you guys were above
that level.

Mitch

Considering Iatrics has a fine newsletter that goes out monthly, I'm of the
opinion that the initial post would have been best served there. If Iatrics
is so bent on besmirching the names of those involved in the litigation they
could have even published a special edition of this newsletter.

I don't believe this forum should be used to badmouth others, regardless of
third party situations they may be involved in, especially considering this
particular litigation isn't finalized and the parties mentioned have not
been proven to be "guilty" of anything. Wouldn't it be best to not say
anything, lest what you say be used against you? I'm not sure how I, if I
were a judge, would view the announcement by Iatrics to a large group of
healthcare workers. Was the announcement approved by lawyers to be
disseminated via the L?

Had a question been asked in the L regarding those mentioned, I could see
that conversation leading to a "oh yeah, they are involved in a litigation
with Iatrics for such and such". But an announcement from Iatrics directly
to the L smells of an ulterior motive to me.

Hiya, Mitch! And the rest of you NPRiddlers!
Nope, I don't consider the posting a boast of any kind - merely a courteous
effort to inform a host of Meditech users of litigation which involves an
active member of the Meditech community. That's what it has to do with the
"L".

I deem it a much better manner in which to be made aware of the legal action
than to read of it in some obscure newsletter.

I don't believe any of the Iatric Systems staff could ever be accused of
"boasting" - though it's certainly justifiable were they to do so. You won't
find a more professional, sincere and knowledgeable crowd of pros within one
organization anywhere else in Meditechia. Many other entities have employees
who are similar in nature and demeanor...but the Iatric Systems folks as a
group - exceptional.

Ya'll have a great day out there.

So is this a boast? What exactly does this have to do with the L?

Mitch
