Keep in mind this peanut may only be pleading not guilty because of the
amount of restitution requested.  Compile a sworn affidavit stating that
you
had the vehicle on the market and that you had been made a serious offer of
$5000.  Find out from the arresting officer who the prosecutor is and give
him the affidavit directly.  Also question the reasons for the plea of not
guilty, because the only defence they have is to try and get the interview
knocked out due to a technicality, i.e. insufficient warning by Police,
poor
parentage, stubbed his little toe when he was three and that made him lead
a
life of crime etc.  Then explain to the prosecutor that you consider the
vehicle worth more than that however $5000 was the offer made to you.
Ensure two things:
a)    the prosecutor relays this information  to the defence well before
the
trial
b)    ensure a transcript of the interview has been read by both prosecutor
and defence prior to trial demonstrating the admissions made by the
defendant.  99% of the time the don't read the brief until the morning of
the trial which causes inconvenience.

  Do all this by questioning the prosecutor - it is your right

You may find that an agreement will be made re plea of guilty and
restitution.

I am unfamiliar with NZ law however if he has made admissions he will have
a
hard time getting off.
