That's the statutory language here in Michigan, but persecutors and law enforcement workers don't obey laws, so statute doesn't matter. They'll just tell you "he was in a marked car, so laws don't apply to him".

I personally know a state police lieutenant (former state highway trooper) who jumped all over a trooper for pulling him over when he was doing 95 in a 70 zone in a state motor pool car (not even an unmarked squad). If I were the trooper that he mistreated, I would have arrested him for reckless driving and refused to back down. "Professional Courtesy" goes both ways, if you aren't courteous, you should forfeit any 'right' you had to claim it.
