While it's unfortunate to see this type of litigation, I'll bet the buyer could 
have avoided the suit if he had simply stated the facts and not made a 
judgement about the "ethics" of the seller.  I have rarely left negative or 
neutral feedback, but when I have it was simply a statement of fact, (e.g. two 
months to deliver item, wrong item, no response to email etc.).  Sometimes our 
anger and desire to be clever can be cause more trouble for us than we expect.
