Yes - they have a copyrighted haiku containing their trademark, and issue licences (free for individuals) to let you use the haiku in your mail to bypass filters *on the condition* that you do not send spam. If you send spam with the Habeas headers, they revoke your license. And if you use the Habeas mark without a license, you're breaking copyright and trademark laws, and they can sue you under clear-cut laws with a long case history instead of relying on nebulous, changing, untested anti-spam laws. They've had success in the past.


Since Sunday, some slimeball has been fraudulently putting the headers in their mail and sending it out through zillions of zombies, sparking lots of discussion over on SATalk

Your best bet, for now, is to report the mail to Habeas using their web form at http://www.habeas.com/report/ or forwarding it to [EMAIL PROTECTED] That way they can (a) add the sending IP address to their list of infringers, and (b) get a bit closer to tracking the scumbags down.
