If you don't want patch to fail you should use either a kernel 2.6.16
(not a 2.6.16.X), or use a kernel 2.6.16.x and merge the failing hunk
manually (not too difficult), or you can use the _unofficial_ patch I
sent to the mailing list a few days for kernel 2.6.16.20. See:
