I am parsing this as: "if we have a static route and receive the same route by bgp, we want to prefer the bgp one". If that's correct, maybe you can arrange that the BGP prefix is longer (e.g. if you have a /24 static, ask the peer to announce 2x /25 and make sure you adjust the filters to permit it)
