With the first line I preserve the name of the way and with the second line
I set the tag name with the relation information.

No you don't. Please have a look at the documentation.
The action "name" is a shortcut for add mkgmap:label:1. So you add the tag mkgmap:label:1. The name tag is unchanged.

With the third line I would add the name_orig always like the second label
but sometimes I see first and sometimes I see like second line... I don't
understand why.

To be precise you set the third label (mkgmap:label:3). As long as the second label (mkgmap:label:2) is not set this will be changed to the second label.

The fourth line is executed only if the first label mkgmap:label:1 is not already set because it is a shortcut for:
name=* { add mkgmap:label:1 '${name}' }

How can I set the second label always a the same position?
