Open source products have *non-patented* stuff -- and in some minor cases (such as probably some source code kindly donated by IBM!!!) patented stuff that has been freely given away.
It might affect Linux only if the European Patent Office give out patents irresponsibly -- which I'm semi-sure they won't, considering the US experience...
