That's partially true. The OS that comes with the n810 contains a good portion of non-free software but you can live without most of it. There are free alternatives to any of the non-free user-space apps that come with the device. The kernel does contain non-free modules (the wifi driver for example) but there are free alternatives. The Mer project is attempting to make a free distro for the n800/n810 devices. IIRC their kernel contains a free wifi driver.
