The way I understand it, flashcards based on some other copyrighted 
material (e.g. a textbook), can be considered "notes." And sharing notes as 
far as I understand is considered fair use. 

As far as selling them or using them in a commercial context? That's an 
interesting question. I would think it wouldn't be a problem given how much 
lecture material is derived straight from textbooks at Universities. I 
don't think anyone will fault you for it.
