The predicate rewrite magic in normalize.brg incorrectly rewrites the query

declare namespace xx = 'http://www.w3.org/2005/xpath-functions';

let $d :=
  <a>
    <b>
      <c x='3'>no hit</c>
    </b>
    <b>
      <c x='2'>no hit</c>
    </b>
    <b>
      <c x='1'>hit!</c>
    </b>
  </a>
  return
    $d/b/[EMAIL PROTECTED] = xx:position()]

such that the predicate is bound to the entire path expression, not just the 
final step.  The effect is a wrong query result.

I removed the check as I assume that at this stage of parsing we do not
yet have access to bound namespaces..
