In theory, according to eBay guidelines, no you can't sell
your account to anyone else. In practice, how will they know if you do this if
you don't tell them? They don't check... and they really don't care...
whose name is on the account or whose name is on the credit card they have on
file for the account -- they have proven over and over that by their inability
to keep people they've banned from creating new accounts. Also, many eBay
accounts are set up as a business, using a business name with multiple employees
of the business handling the account, so just the fact that a new email address
or new person was dealing with the public through the account wouldn't cause
eBay any concern. So, if you quietly sell your eBay account to someone, unless
you make the transaction pubic, no one is going to know.
Or, let's take the example of a big company, like say,
Heritage. Heritage does a lot of business on eBay under the Heritage company
name. Now, does anyone seriously believe that if some other big company comes
along and buys Heritage from the current owners that eBay is going to tell them
they can no longer use the existing eBay account for Heritage -- that they
must start over on eBay with a new name and zero feedback? I don't think
so.
So, like so many other eBay rules, it is not enforceable. I
know for a fact that eBay accounts change owners all the time.
PS -- why did eBay just send you a boiler-plate notice as a
bidder on the COCONUTS cards meekly stating that the seller was not longer a
member of eBay and the auction was cancelled, with no more details than that?
Two reasons:
1) It's easy. Just have a standard, non-specific letter which
covers all situations and send that out automatically. You don't have to
get staff involved and worry about phrasing more specific
details.
2) It covers their ass legally. If they gave specific details,
then the banned member could have grounds for filing a lawsuit, claiming
defamation of character and damage to their business. Even if the details were
true and eBay could prove it, they would still have the expense and hassle of
doing so in court. Easier just to say "this person is no longer a member of
eBay and the auction is cancelled." No liability on something like
that.
