Bringing a lawsuit is extremely expensive, extremely time consuming and when
you cross state lines you must contend with using local attorneys, different
state rules and making court appearances. You cannot sue for lost income.
You can only sue for specific performance (i.e. to have the title of that card
transferred to you by the court by proving it is a one of a kind, unique and
not replaceable) or for damages. However, you must prove damages, which is not
an easy task.) You will also need witnesses willing to travel to the other
state to testify. Attempting a lawsuit such as this is like trying to swim up
a
mountain with water cascading down at you.
Even if you file a lawsuit what do you do when the seller replies to your
expensive legal eagle by submitting an affidavit that it was destroyed by
accident which is why he tried to stop the auction. Whether true or not, how
are you
going to prove otherwise?
To sue may be an option (a poor choice) but a better choice is to file an
ebay complaint and call it a day.
