aha... the old " Liklihood of confusion " theory rights its ulgy head.........

In trademark law this is why we get trademarks to set apart the Liklihood that a similar name can confuse the buying public. of the surce of goods and services...

I bought 1000.00 worth of Law books when in 1993 a company went on Nasdac after the USPTO had

refused to register there trademark application citeing ' Liklihood of Confusion" Theye wanted to call themselves " Dream Factory" Since 1977 I have used the trademark and it is a fully registrated

incontestable Trademark Hollywood dream Factory® and we are known also as " Dream Factory" as

its the domiinant portion of the name and ' Hollywood" is not trademarkable by itself so Dream Factory is our dominent portion and used in the are of Motion picture collectables is becomes strong in that field..

we only allowed one group to use the name nationwide { Free Of Charge) in Lousiville, Ky

called the " Dream factory" a non-profit 501-c3 Organizaton that grants wishes to childrens that are terminally ill. and they may not sell the trademark or use for memorabilia.. was the aggreement.

I alwys tell people to be carefull of infringing the product or trade dress of company because it can backfire if that company gets a bad rep and its called reverse confusion.

so If anyther company is thought of..... well..... then so what.......


so..... in the middle of my trademark lawsuit againts the infringers ... another Dreamer surfaced... yep....

Dreamworks....... now I may be stupid but I aint dumb,,, and I love Spielbergs stuff as You know...

so.... when Linwood Dunne asked me well what does Spielberg think of your name.... I thought

hey....... I have no idea.. and if peole think Im part of them... well what better to be associated with,,

thank God it wasnt  Nazi's re us film company... thats would be bad.....


Moral of the story... beat your own drum and develope your own brand ,, instead of copying others....

at same time we are all a evolution of others ideas.. we dont really invent as much as improve, modify and

as edison said we discover by accident most the time while looking for other stuff.........

Im makeing zoetropes that were invented in 1834 and just improving and honoring the original craftsman......
