First, I can really sympathize with your situation and it was never our
intention to add insult to injury.  However, Debi came to us and asked us
how she should handle the situation.  We have NEVER advised Debi to not
refund the money.  Because of the way this situation was handled in the
first place, we advised her to go to an attorney and do it the proper way so
that she would have the documentation and card necessary to try to recover
her losses, including the insert that Haggard got from her, from other
parties.   Any prudent business person would have done the same thing.
Remember, once she refunds the money, she is then out the money AND her
poster.  Without proper documentation, she cannot take any further steps to
seek recovery from other parties.
 
We would never have addressed this situation on a public forum.  However,
Sean caste a disparaging light on LAMP and ALL our dealers and sponsors
without obviously knowing the facts.  If he did know the facts, he sure
didn't make that clear.   He instead decided to take a swipe at us and ALL
of our other dealers and sponsors.  
 
You acknowledge that you and Debi were pushed into this transaction.  I feel
very confident that this situation will be resolved between the two of you,
but it should be done properly in light of the current situation with the
fake posters and lawsuits.   You have already been victimized -- we were
simply advising Debi to take the proper legal steps to prevent the same from
happening to her.    
 
I worked in the law field for 30 years and I will ALWAYS suggest that
matters be handled legally to avoid this kind of mess.   I disagree that
advising someone to seek counsel is "bad advice" and I won't stop doing it.

Susan, I am totally shocked at your false accusations.  I am laying low
because Kerry can use anything against me.  But this is awful, your comments
are 100% wrong.

I have NEVER refused to give Debi information, the report, or the poster.
To say differently is 100% false.  I have always intended to give her the
report and the poster.  Debi never once asked me for it, until an e mail at
7:32 this evening.  And, I immediately responded that the poster is at Carol
Tincups as well as the report.   I told her, if she intends to make this
right, I would be happy to send her the card and the information.  

Secondly, there is only one person who gained financially from that
transaction.  Debi got 100% of the money.  Yes, Kerry and Freeman did push
Debi & I.  But, Debi sold me Kerrys card.  debi got the check, Debi got the
profit.  Yes, I have been very frustrated.  Every legitimate dealer has
stepped up to make things right.  Heritage never argued, just reimbursed.
Profiles in History, paid people immediately.  Poor Joe has been maligned,
yet I tell you he made things right immediately.  Even Filmfootage who is
very much doubted, is working to make things 100% correct.  He is standing
up to his fakes and reimbursing people.
I myself am making things correct, despite the fact that I have been shafted
to the tune of almost my entire retirement.  Yet, I am making things right
if I sold a card from the "alleged thief."

Susan, what would you do if it was you who were out $900,000?  I bet you
wouldn't be nearly as understanding.  I like you & I like Ed.  Ed has even
offered to help our attorney.  However, you are NOT the authority on this.
Please stop giving bad advice.  Please.  Debi sold me a bad card, and I
expect her to make it right.  Its pretty easy to be an expert when you have
NO MONEY involved.  I have enough problems without answering every goofy
posting.  Please let Debi & I work this out.  It was only that e mail 2
hours ago where she indicated she would.  Everyone needs to step up to their
mistakes.  Even if its not their fault.  I have a couple of cards and a
major trade that I will be addressing.  They total over $50,000.  But the
right thing is for me to try and resolve things.  The same is true with
Debi.  Susan, you have no idea how much the legal fee's are.  I feel
responsible for our hobby.  Despite the fact that there is serious doubt as
to what I will ever recoup, I am forging ahead.  I feel the need to
represent our hobby and make sure the guy who "allegedly" screwed up our
hobby pays for his wrong doings.  Is anyone willing to help with the
finances?  I dont think so.  Yet, I want to help our hobby despite the
costs.  Yes, I want to get even.  But I am doing it for the little guys.  I
am doing for the 20 people I am aware of who were taken.  Is it too much for
me to ask one legitimate dealer to reimburse me for the fake card?  I dont
think so. 

Sean was correct.  His point is that people need to step up and do the right
thing.

When you make an accusatory statement such as this on a public forum you
should first know all the facts and not present just part of them -- in all
fairness to the parties involved.  I can only assume that you are referring
to the "convoluted transaction" that transpired a year ago between Gresham,
Haggard (who Debi didn't even know and still doesn't), Debi and a fourth
party acting as an agent.   The transaction involved a poster Debi owned
that Haggard wanted. He wanted to trade one of his posters along with some
cash.  By the end of this transaction, the poster that Gresham received WAS
NOT Debi's but was from Haggard.  Now, a year later, Gresham is demanding
Debi refund the money but refusing to provide a report establishing that it
is indeed a fake, without returning the alleged fake piece and telling her
NOT to seek the advice of an attorney.
 
We told Debi and Gresham that we suggested that Debi NOT proceed until she
had time to speak with her attorney on how to proceed and protect her rights
against one or all of the parties involved in this tangled mess.  Debi wants
to do the right thing and has not refused to refund the money -- she just
wants to protect her rights to proceed.  If not, Debi is then left with no
money and no poster.  To date, Gresham REFUSES to even send the fraud report
and he HAS NOT assured her that she will get the "alleged" fake poster back
so that she can proceed against the other parties. NO REPORT -- NO POSTER --
NO ATTORNEY -- JUST SEND ME THE MONEY!   She is simply being pressured to
send a refund -- no questions asked.  I don't know any business person in
her situation who would not want to protect herself.
 
This situation is NOT a straight up sale between two individuals and your
email leads EVERYONE to believe that it was.   Next time, why don't you just
ASK the parties involved and get ALL the facts before you post an
inflamatory email that could ultimately hurt Debi's business and cast doubt
on LAMP dealers and sponsors.   We have spoken with Debi in detail AND with
Gresham in detail to make sure that we had all the facts. APPARENTLY YOU
DIDN'T.  Ed specifically told Gresham that he had advised Debi NOT to
proceed without speaking with counsel and WE STAND BY THAT ADVICE.  I would
definitely question the motives of ANYONE who would advise a colleague NOT
TO SEEK THE ADVICE OF AN ATTORNEY.

For the past couple of weeks I have been openly wondering about whom Bruce
was referring when he stated in one of his email messages: "It seems that
some of those who unknowingly sold some of these as middlemen are taking the
odd position that they have no liability in this, and that they want the
people they unknowingly cheated to join them in lawsuits against those they
obtained the fakes from, and that they won't be refunding those they
unknowingly cheated."
 
Naturally, I personally would not want to deal with anyone who was not
accepting any responsibility in this sort of a situation.  
 
At last I have finally found the dealer (or at least one of them) that Bruce
was hinting at: 
It is none other than Debi Jacobson from L'Imagerie Gallery in California.
 
What is even worse is that Mrs. Jacobson is a LAMP approved dealer and
supposedly represents the "very best our hobby has to offer."
 
Apparently Mrs. Jacobson has known for a couple of months now that a lobby
card she sold to a prominent collector has been determined by third-party
authentication to be fake, and she has not made even an offer of one penny
of restitution to the purchaser.
 
This is another shameful black eye, and a horrible position for one of the
supposed premier galleries in the hobby to take, but I guess it's ok to
cheat people when you are LAMP-approved.
