I have no blame on Joe for selling the fake Dracula WC (that blame lies with
John Davis), or on the fake Dracula 47 1-sheet that he sold before knowledge
of the fakes became widespread (and I do know that he refunded both
purchases).
That's why I tongue in cheek suggested that Rega picked the right place to
send his fake Dracula.
My only point was that I hope Joe didn't go ahead and sell the real posters
that Rega may have sent once it was discovered that he purposely altered the
poster to deceive Profiles. The only way to deal with someone who is
purposely making fakes and selling them is to cut off all dealings with that
person - whether it's Tom Loce or Tom Rega.

I think that blaming Heritage or Profiles, Jim Gresham, Ralph Deluca or
anyone else who dealt/sold/auctioned these posters isn't being fair. Joe
Madalena is a victim, not a perpetrator. He didn't go out looking for
forgeries to sell in his auctions. As a matter of fact, not only did
Profiles immediately refund monies paid for the items sold in the auction
with the Dracula window card, but when he was going to handle the Dracula
one-sheet, he did just what he was supposed to do - he went to John Davis
and paid John to authenticate the poster. It was John who completely fell
down on the job, not Profiles.
Similarly, anyone who sold/auctioned/dealt one of these posters BEFORE the
fraud was actually discovered is a victim and not a perpetrator. How can
any one individual or entity be blamed? This wasn't exactly a Nigerian
Money Scam where the victims needs to have their head examined for
becoming a victim. This was a high crime committed on these people with
the co-operation of a top restorer who helped to hide the reality of these
items.
Of course, we again can point to John Davis, who when re-backing &
re-restoring the Dracula window card did not detect the reality of this
piece which would have revealed the fraud months earlier.
the victim list is a very long who's who of the poster hobby and I don't
blame any of them for being involved. Haggard is a Bernie Madoff. He
befriended everyone - including me. The only reason I didn't get screwed
is because when Kerry offered me pieces, I said no because I'm not
interested in restored items, much less heavily restored items, and that
immunized me. I have seen some of the Haggard fakes - from lobby card to 3
sheet size - I can say these were very convincing items - most especially
the 3 sheets and one sheets.
so don't blame the victims. blame the asshole who right now is eating
baloney sandwiches at taxpayer expense. I can say one thing though.. I
don't mind paying for the baloney so much in this case.

I think it is interesting to note that in the article Phillip just
referenced,
that of the 11 posters Rega sent in, only two were determined to be
fakes - and then later the Dracula.
Does this mean Profiles happily sold 8 other posters that this fraudster
sent to them?
Can't really blame him for sending a fake-worked on Dracula poster to
Profiles for auction,
they had already sold a couple of other fake re-restored Dracula posters
so why not another?

The only information I ever saw about legal action were various reports
similar to the following
http://www.courthousenews.com/2010/02/10/24563.htm
the status of that suit or any subsequent suits, settlements or other
actions are unknown to me. Perhaps others have more current info.

I believe so

Was the Dracula ever reported to the authorities?
When I think of it, I have read a lot about the shenanigans of Haggard
here and there but hardly anything about that Dracula poster since it
was discovered to be a fake (or rather an altered lithographic
reproduction).

him and Diane Jeffrey of Studio-C originally backed it for the perp,
but included incorrect border information supplied to her so people
would know the poster was not real. John Davis of Poster Mountain who
subsequently worked on it to correct the incorrect data did not however
notice the fraudulent piece, for which he was widely derided
