Bob Ekblad forwarded to me the following e-mail he received from the Army Corps of Engineers confirming that birders no longer have access to the 40th Ave West Erie Pier Area in Duluth and should not attempt to enter this site. (Neither Bob nor I can explain why he received this e-mail, since he is not involved with the Sept 24-25-26 Minn Birding Weekend in Duluth. Note that the e-mail was sent from the legal department of the Army Corps of Engineers in Detroit!) It is still unclear whether or not access will be restored after the I-35 project is completed.

I received the attached e-mail regarding the 40th ave site. I tried to send a note to the people at Hawk Ridge but it wouldn't go through. I assume someone from the Duluth area will want to work out arrangements to allow access once again after construction activities are completed.

The scheduled Hawk Ridge event will need to be changed to exclude this area.

It's been brought to our attention that your organization is planning a briding event at Duluth's Erie Pier September 24 -26, 2010. Please be aware that Erie Pier is an active construction site that is under the management and control of the United States Army Corps of Engineers (COE). This is not a site that is safe for the public to enter due the multitude of trucks and construction equipment in operation. In fact, as a matter of safety, the COE's contractor requires all visitors for business to sign in and out in
order to keep track of those on the site.  Due to the current state of
construction at Erie Pier and the presence of many hazards, the COE cannot grant you permission to enter the property at this time. I request that you cancel your plans to visit Erie Pier. If you have any questions, please
don't hesitate to contact me.
