The protection of MN birds and US, Canada, and Mexico birds was established
by the Migratory Bird Treaty Act of 1918.  A 2017 Dept of Interior opinion
exempted "incidental take" of birds from protections under the MBTA.  The
judge ruled that both intentional and incidental take are addressed by the
MBTA.  This is a good thing for all non-game birds and may help to slow the
decline in bird numbers across the country.
