What gave you that idea, if I may ask? Perhaps the spec needs clarification here?

I didn't know that you could do side by side comparison of deeper nested elements (yellow div) with other elements (green div). That would be a mistake of me.
But I totally missed out appendix E of css2.1 (point 7) which David Baron pointed out to me, where positioned elements with z-index:auto should behave like it is creating a new stacking context.
So in that way you could compare the two base divs with each other (the red and the green one).
Both have position:relative, so the order in the document tree becomes the deciding factor.
