The people who "made all the rules" were the intial developers themselves.
If you want Open-Source/Free Software that isn't subject to US Export Law, use the GNU GPL.
GPL has nothing to do with export restrictions
if the software is developed in the US or is served off of servers in the US the restrictions apply
