You need to be specific about exactly which code you mean. I believe the situation is that most of the Mozilla crypto stuff has been tri-licensed on the CVS tip, but a stable release hasn't been made since.

The NSS tip has recently been tri-licensed. You need to either use the CVS version or (better) contact the NSS developers and ask them when they plan to make a new stable release.
