Phyllis Kahn writes about what I understand we now officially call the metal shredder because the old reference is to the brand name of a machine that will no longer be used:
She states: ��. by state law radioactive material is specifically excluded from the definition of hazardous waste� and �But as I understand it, this DOE proposal may remove the title "radioactive" from the metal waste and this would become a likely loophole�� [TB] I suspect there are a number of definitions of �hazardous� in various federal, state and local laws and regulations. Its been a few years since I�ve gone through hazardous materials training as I am no longer in the air charter business, but a few questions do come to mind. - Are there any federal or local laws or regulations that define this stuff as hazardous? - Why is the label �radioactive� being removed? I guess I�m not clear on what is going to be ground up in that plant, but is it truly not radioactive or how have the definitions changed? - If it was excluded from being hazardous because of being radioactive and we no longer define it as radioactive, does it now fall into some other definition of hazardous? Back to �this DOE proposal _may_ (emphasis supplied) remove the title radioactive.� That implies that they also may not. What is the likelihood that this will happen? It then gets back to why would the label be removed. This whole issue is caused by a problem that we have with Minneapolis City government. First the City Councilmember in whose ward this project lies was able to and DID APPROVE the permit. Sometime later the city decided to revoke the legally issued permit and instead of trying to reach some kind of reasonable settlement our city �leadership�. Generally we are moving industrial sites off the river and using that land for housing and parks. We have Mayor Sayles-Belton telling us that she is the CEO of the City and has provided great leadership. This is one of those many instances of total lack of leadership we have seen from her during the 8 years she has been mayor and her time as Council President before that.
