I say:

Phyllis evidently feels that the law or at least the
spirit of it has been violated as it relates to the
city council election.  When this issue is in the
court room, no one will be debating whether or not it
is a GOOD IDEA idea to force a new election. They will
be debating whether a new election is REQUIRED under
the current state law. If the attorney representing
Phyllis and others win the law suit then I would say
it proves that the current situation isn't lawful and
that an election should then be held. We can debate
all day all the could a should a would a's of the
issue but the law will determine how this will all be
rolled out. 

If people aren't happy with the law they way it is
written then they should organize and change it.
