What criteria are used by city hall to determine a marriage applicant's
gender? Suppose two transgender individuals go city hall for a marriage
license one claiming to be a man, the other a woman. What about those
who've undergone sex change operations, do they receive some medical
certification validating their new gender? Is it up to the city clerk to
inspect the genitals of each applicant in order to make a determination?
I hope the absurdity of this example demonstrates the futility of
demarking lines in these murky waters. Let the "sanctity of marriage" be
upheld by churches willing to hang out on these fragile limbs.
Government for the people, by the people should not discriminate in
issuing licenses for marriage just as they are not allowed by law to
discriminate in hiring, housing or granting a drivers license.
