I appreciate the fact that Leslie Davis filed a suit against the government to attempt to end the transit lockout/strike. Is it possible that he filed a suit based more on enthusiasm than law?
Are companies still submitting payments for Metro Passes to the MTC? Do those companies and employees have a cause for action for breach of contract? The system could have continued under the old contract. State Middle Management Association (MMA) frequently work for one or two years under old contracts before settling even when they have already started negotiations on the next contract. That was an option offered by ATU 1005. Was the rejection of that proposal a Metro Pass contract performance failure by the government? I have a partially used Saver Card and a pristine replacement Saver Card. Will I be reimbursed if the Legislature and Governor liquidate the mass transit system by turning it over to a private company? It will just barely be cost effective to file in Small Claims Court to recover these funds. I might not be able to bicycle to court that time of year or under the then existing traffic or weather conditions any time of the year. In the past, a private firm in Cincinnati actually managed the bus system for MTC. Is the system still managed by a private firm? Are they receiving pay during the strike?
