The front yard at this house is just 10 feet by the lot size of 48 ft with steps 
leading up to both sides of the duplex. This child does not live at this address full 
time. There is a large Back yard which is much more appropriate for playing outside. 
This was all taken into  account when this decision was made.

  Dyna -- you're getting all worked up, and threatening "multi million dollar 
  class action" lawsuits, about nothing!

  Minneapolis zoning allows backyard fences up to 6 feet high, without 
  requiring any variance at all.  (Any competent fence builder would have 
  been able to tell you that.)  So just build it!
