Thanks for the replies… a great source of information.

I will have to investigate some more as not seeing this at all.  We do have 
Internet Client Base Management enabled and the DP that acts as Internet DP 
does not have WSUS on, but with this setting enable should not matter and still 
go out to the Internet and download the require update(s).
The only other thing that could be causing this not to work, we are using 
Adaptiva for are SCCM deployments.

If anyone else has any suggestion in the meantime while I continue to 
troubleshoot would be great appreciated.

We have definitely experienced it working, in a way that we didn't intend.  
When some updates didn't get distributed to remote DP's, we ended up with all 
of the computers in the remote offices trying to pull down updates from the 
microsoft servers at once, bringing the internet connections to their knees. . .

The key statement here is that the update was not available on the DP. This 
checkbox enables a “fallback” method of downloading the update binaries. It 
does not circumvent the updates coming from your DPs.

We have used this in the past and has worked as stated in both networks. Any 
time a patch was not found on a DP, clients would fall back to MS. It worked so 
well that saturated one of our remote offices in one occasion.
