Reformatting after the first successful format will necessarily fail.
Upon deleting/reloading an applet, the applet is in the state where formatting is required.
One should be able to delete/load/format as many times as one wishes. Although, recapture of flash/eeprom after deletion is an "implementation matter". Implementation issues could thus cause the effect.
The fact that you are getting system vs. muscle errors, suggests that its the memory manager that is causing the exception. This is consistent with the initial problem.
There are other sideeffects, too due to reloading cap files. On one vendor's VM, reflashing the applet's load file causes the card's T0 engine to start issuing many more 0x60 delay signals to a muscle client, compared to an applet that was virgin-flashed.

Well, as it turns out - sometimes.
Right now I am using a GemXpresso Pro card (with the GemPCTwin reader in USB mode)
I tried deleting the applet, and reloading it. This seems to work.
When I try to re-format the token a second (3rd, 4th) time using muscleTool, however, it fails:
Doing the same formatting as before, I now get:
