Hmm.  Perhaps something to do with list handling has changed between
your version and the latest from the development arch archive [which is
what I have here].  The last list-related change from the ChangeLog that
I have is

2006-08-26  Michael Olson  <[EMAIL PROTECTED]>

        * lisp/muse-publish.el (muse-publish-surround-text): When looking
        for indented list items, ignore blank lines.

That looks like it might have some bearing on this. Perhaps the Muse
version you have hasn’t caught up with that yet. Or perhaps something
else and rather more enigmatic is causing our formatting differences.
