My understanding of the issue is that yes, this is more or less the case.
However, this would be illegal for a MythTV developer in the US to do, so you would have to get branched source and binaries from outside the country.
(I'm of course assuming you are American)
I can just see the underground sources poping up on P2P with the broadcast flag commented out...
