I'm using 2.6.14-gentoo-r4 and lirc-0.7.3pre1. I used --with-transmitter and --with-driver=serial in my configure script. Did you make sure to use the following line somewhere in your startup scripts?

/bin/setserial /dev/ttyS0 uart none

If you did or that doesn't get it working, I will send you my kernel .config offlist. HTH.
