Thanks for the info.
1 question.
Salaried employees. Is that law nationwide?
If so, my son who is 21. Is seriously being taken advantaged of he works 54+ a
week for $400. Ya it comes out to just over $7.00 an hour. So if they owe him
for time and a half since mid February that's a good chunk of change. Ya think.
Where would I get a copy of THAT portion of the law? He just may need it for
leverage because they keep sending him home early because they are "slow" right
now.

You know I forgot to tell you guys that I went to a 3 hour Us
Department of Labor Seminar. (My life is soo exciting) LOLOLO

But a few interesting things that I learned. If you didn't know the
Department of Labor (DOL) is to make sure employees are paid
correctly and not working 80 hours a week at below wage or not enough
time paid.

Did you know there is a diff. between hours worked vs. hours
paid? They investigate on worked hours not paid hours?

Did you know that they will get your back wages for you, only up to
minimum wage $7.25 an hour, or any overtime, but if you make more per
hour you have to file a civil suit?

Did you know that they DO NOT regulate vacation time, sick time,
lunch hours, break times, holiday pay, severance pay, fringe
benefits, insurance? Which means as an employee these are not
required by law and it is a benefit from the company. The company
does NOT have to give you a 15 minute break, a break or lunch break
is a benefit, NOT a law.

Did you know that the employer can make you work 20 hour days? (There
are states that set minimums at this)

Did you know that the DOL sets standards of 40 hour work
weeks? Anything over 40 hours is time and a half? So you can work 2
- 20 hour days, but then you have to stop or get overtime.

Do you know why we have 40 hour work weeks? It was to screw the
employer and help the unemployed. Years ago employers would hire
super employee that needed the money, who was a hard worker. The
employee would not get overtime, and worked and worked. The employer
had a great employee who needed money. Then the Gov steps in and
says hey wait a minute, there are thousands of people out there that
need jobs, and you keep working the same person. So we want to help
the unemployed. So you can keep your super employee but you have to
pay that super employee time and a half over 40hours. So if you
don't wanna pay, then hire some more people. TA DA,, the 40hour work
week and time and half!!!

Did you know that salaried employees does not mean you can work them
80 hours a week? Nope, you can pay them salary (not hourly) and
still have to abide by the 40 hour work week rule. UNLESS they are
in a management position. And the DOL will ask for proof of their
supervision duties.

Did you know that if you are a tipped employee, (waitress) the
employer has to make sure that you atleast reach minimum wage, and
they have to make up the diff. Tipped employees make $2.13 an hour.

Did you know that employees of theaters do not have to follow DOL
laws? (confused about this one), something to do with entertainment industry

Did you know that amusement park employers do not have to follow DOL
laws? Based on if they are open 12 months a year (yes they do) vs. an
amusement park of only open part of the year. depends on how much of
their income is generated in a certain time.

There are gobs of exceptions, can be confusing, but you can read the
info at www.wagehour.dol.gov.

Your exciting news for the day!!!!!!!!!!LOLOLO diana from indiana
