I agree that there appears to be an ambiguity in the buildfile. However, since a FileSet is not a task, and only tasks are executed by foreach (since it is a TaskContainer), there is no real ambiguity.
I also agree that this behavior could be made somewhat clearer by a special <do> subelement, though.
