Judge throws out sexual harassment lawsuit against ousted Seminole leader

TAMPA, Fla. (October 20, 5:34 p.m. ADT) - A judge threw out a sexual harassment lawsuit against ousted Seminole Tribal Chairman James E. Billie this week, saying federal law exempts Indian tribes from such suits.Christine O'Donnell, the tribe's former director of administration, had alleged that Billie got her pregnant, forced her to have an abortion and then fired her, paying her off with $100,000 in tribal funds.U.S. District Judge Donald M. Middlebrook said the allegations are "disturbing," but said he had no choice. He issued his ruling Thursday.O'Donnell's attorney, Andrew Hall, said he would refile the lawsuit in state court.A call placed to Billie's home Saturday was not answered and his attorney, Robert Saunooke, did not immediately return a call. Billie has previously denied wrongdoing.Billie, 57, led the Seminoles from 1979 until May, when the tribal council suspended him and stripped him of his $312,000-a-year salary.Billie is being investigated by a federal grand jury looking into allegations of embezzlement and theft involving federal grant money, according to a letter previously sent to the Bureau of Indian Affairs.Last month, the tribe filed a federal lawsuit against Billie and his former administrator, Timothy W. Cox. In the lawsuit, the tribe accused the pair of overseeing a stock manipulation scheme that drained the Seminole treasury of $20 million.
