 Senate Bill 1816, by Wesley Chesbro, may be opposed unless amended by the
universities and some state agencies.  They believe that the bill will not
allow them to conduct academic excavations of cultural site, which isn�t
necessarily a bad thing.

This bill establishes stiffer fines and imprisonment in county jail for up
to one year for impacting cultural sites on private and public land.

your local legislatures for it and write letters of support. Without your
support, it will be difficult to pass.

BILL SUMMARY:

SB 1816 establishes the Native American Historic Resource Protection Actt,
which creates  a new crime for destroying, injuring or defacing Native
American historic, cultural or   sacred sites, punishable as a
misdemeanor.  The bill also provides for an additional $50,000 civil
penalty for violation of this Act and requires the Attorney General to
bring a civil action upon a complaint by the Native   American Heritage
Commission..

STAFF COMMENTS:

Because the bill requires the Attorney General to bring a civil action,
upon a complaint by the Native American Heritage Commission, some increased
costs to the state would occur as a result of this bill.  If the AG
prevails in the action, it would be eligible for reimbursement for attorney
fees.  If the AG does not prevail, its costs would be borne by the General
Fund.
