The case that is being presented is one that without further pressure from both neighboring governments and indigenous peoples is having a drastic affect both now and in the future for Canada's Indigenous Peoples. Please keep in mind that the current case has resulted from past assimilation and genocidal tactics that the Canadian government has directed upon Indigenous people of this country. This statement also includes solutions that both aboriginal peoples and the government can partnership to create a positive changes in the current justice system. Case Study: In November of 1998, a police action termed Operation Snow targeted up to fifty members of the Manitoba Warriors. A massive police sweep involving the Winnipeg Police and the R.C.M.P. rounded up nearlv forty members of the Manitoba Warriors. They were charged under various Criminal Code violations, however they were also charged under new legislation, the anit-gang or criminal organization law. As of July 10, 1999 not one of those Manitoba Warriors who were charged have been allowed bail. This would not look so bad if it were not for the fact that a similar sweep of Oriental drug dealers in Winnipeg were also charged with the same legislation and granted bail; as well white persons with living off of prostitution were charged under new legislation and granted bail the same day. It seem that there is two Set of laws operating in Manitoba seemingly based on race. The new criminal organization law as it is currently being applied in the case of the Manitoba Warriors is a violation of fundamental human rights and is inconsistent with the Canadian constitutional right to be considered innocent until proven guilty. The means to which this new legislation is being enforced in Manitoba means that anyone who is charged with being/associating with the Manitoba Warriors can be held in jail without the crown being forced to prove its case. In retrospect, these new laws are being enforced much the same as previous Indian Act laws. Such as Section 100 of the Indian Act, which was used to provide that an Indian charged with a violation under the Indian Act was guilty until he or she proved themselves innocent. This since has been repealed. Positive Solutions: -Mandating that all Justice officials of any form take cross cultural training and that this program is further developed publicilly by aboriginal peoples to create a better partnership for aboriginal and non aboriginal peoples. -The Implementation of the recommendations of the Aboriginal Justice Inquiry, -Continued support from Canadian Government to aboriginal peoples as they implement traditional healing and rehabilitation programs through greater access to prisoners and financial Support, -An independent agency to facilitate, document and support persons within the Justice system and who have experienced any discrimination or violation of rights, -Ultimately, through greater self determination that the government recognize the right of aboriginal peoples to facilitate their own traditional forms of justice. Statistics: -Aboriginal detainees have a 21 percent chance of being granted bail, white non aboriginal detainees have a 56 percent chance.
