The $1 billion Waste Isolation Pilot Project is slated to open sometime in mid-February, but shipments could be sent before that time, he said Saturday. "In my view, WIPP is ready to open," Mr. Richardson said. "The project has satisfied a number of health conditions at the state and federal level. I believe shipments can move forward." The former New Mexico congressman also said he is working with the state on a permitting process. But he wouldn't say whether his agency would try to ship 116 drums of Los Alamos National Laboratory waste to the site without a permit. "We want to work with the state ... not against it," he said. The U.S. Department of Energy filed arguments in U.S. District Court last month stating the agency should be allowed to open WIPP without a state permit for hazardous waste. The department contends no permit is needed for nuclear waste that doesn't contain chemicals specifically regulated by the state, such as lead and solvents. State regulators agree the waste from Los Alamos is free of hazardous materials. But they have raised concerns about the DOE's plans to ship more waste once the 116 drums are moved to WIPP. "We will ensure that the interests of the state are protected," Mr. Richardson said. "It is my view that WIPP is safe." But WIPP faces another federal lawsuit filed last year by several groups that could delay its opening for at least two or three years.
